Terms of Service

Service Cost Terms
A minimum deposit of 50% is required before the commencement of any website setup or design work. The remaining amount is due on completion. Website setup and/or design services are priced on an individual case-by-case basis. A price is computed by the designer (Deena) and if agreeable to the client, work can commence at an appointed available time once at least the minimum 50% deposit is received. A duration time is also estimated and quoted to client when the deposit is received.

Consulting or Educational training time outside the scope of the site setup appointments is by appointment only. (see Design Process for more details) Once the time interested in reserving is set and purchased an appointment can be set for the next available time frame. Consulting time or additional service work is at the designer’s (Deena) standard hourly rate of $55 per hour, based on the quarter hour. A minimum charge of $20. per individual appointment will be incurred. Consulting and training time outside of a setup package is on a retainer basis and service time purchased is due in advance.

Supply of Materials
The client is to supply all materials and information required to the designer (Deena) to complete the website in accordance with the agreed specifications. Such materials may include, but are not limited to, photographs, written copy, logos and other printed materials. Text content needs to be in either MS Word or Notepad text format. Where the client’s failure to supply materials prevents progress on the Work for more than 21 days, The designer (Deena) has the right to invoice the client for any part or parts of the Work already completed.

Consequential Loss
Under no circumstances will the designer (Deena) be responsible or liable for financial or other loss or damage caused by the failure or use or misuse of its software. The Client should ensure that data on their site is regularly backed up and that a contingency plan is in place to minimize possible losses as a result of software failure.

Search Engine Listings
Freebird Media does not guarantee listings on Search Engines. The client further understands there is no guaranteed placement or rank on the Search Engines and that a new website may take up to 6 months to even appear on Search Engines at all.

Copyright
All material including text and images, supplied by the client will remain the client’s property. The client is completely responsible for securing all necessary licenses or permissions for content that is supplied to Freebird Media. All such material supplied by the client will be assumed to be the property of the client and therefore free to use in any development without fear of breach of copyright laws.

The copyright for all material provided by the designer (Deena) such as code, graphics, photographs, images and text, will remain the property of the designer (Deena) until such time as payment has been made in full whereupon they will become the property of the client. With the exception being items that fall under the GPL open-source license.

Freebird Media reserves the right to use a screenshot of the completed website on the developer’s website.  Freebird Media also reserves the right to re–use any rejected design concepts.

Browsers & WordPress add-on features (plugins)
Freebird Media makes every effort to design the pages which display acceptably in standards compliant browsers to the standard moderated by the World Wide Web Consortium but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed. The same goes for WordPress plugins, the Freebird Media will make every effort to make sure that the plugins and the current WordPress version all work together effectively. Changes made by the independent plugins developers and WordPress software upgrades are not guaranteed to work together after future upgrades.

Estimated Time & Completion
A time completion estimate is given after your order is accepted and your deposit is processed. Payments are accepted online via Google Checkout – you are not required to have a Google Checkout account in order to pay via credit card. Payment will also be accepted by US Mail, if you prefer. (Note: orders exceeding $1,000.00 are subject to a 3% processing fee for online payment – if you’d rather avoid the processing fee; payments are always accepted via US Mail by method of business check, bank draft or money order.)

Email consultation, for established client projects, is provided to you free of charge – Up to two hours total general blog orientation and design consultation is included in the initial quote. Additional education and consultation is billed at our normal hourly rate.

Cancellations
Both the client and the Freebird Media have the right to cancel at any point in the job progression if they feel that the designer/client relationship is not a correct match. Refunds by Freebird Media or payment due by the client is dependent upon how many hours Freebird Media has put into the project. A canceled job’s cost will be priced by an hourly rate of $55.00 per hour plus and processing fees, data transportation preparation time or mailing fees. Items created, setup &/or customized for the client will be released by Freebird Media to the client once final payment for service hours have been paid in full. Unpaid project work will be held until full payment has been received by the client and legal recourse may also be pursued. If legal recourse is needed to collect client fees,

A job cancellation request needs to be in writing, either issued by the client or Freebird Media. A written email request is acceptable to see any further service changes. The only except for any additional costs would be for preparation of current work for transport. This work include any theme customization, artwork, special features or web content. Transport preparation costs would be priced at the standard hourly rate terms.

Default in Payment

If payment is not received the designer (Deena) reserves the right to suspend work on the project and/or remove the Website from the Internet until the invoice is paid. If any outside agency is used in collecting an outstanding debt, then these costs will also be added to the account. The Client shall assume responsibility for all collection of legal fees necessitated by default in payment.
